Brother of 'Datuk Kabi' charged with 11 counts of cheating

KUALA LUMPUR - MALAYSIA: A mover, plumber, electrician and a fourth man.
These are the people allegedly cheated by a man, said to be the brother of "Datuk Kabi" and his ex-wife using cheques amounting to more than RM90,000 which subsequently bounced.


Yoganandha Moorthy A/L Chitravelu aka Steven Raj, 35, was charged in two Sessions Courts yesterday with 11 counts of cheating while his co-accused Mercy Sumathi Christie, 40, faced six similar charges.


Both pleaded not guilty to all the charges.

Yoganandha Moorthy A/L Chitravelu aka Steven Raj is the elder brother of "Datuk Kabi", whose real name is C. Kamaleshwaran, 29.

Earlier this month, Kamaleshwaran was charged with eight counts of cheating -- three in Balik Pulau, four in George Town and one in Butterworth magistrate's courts.

He also claimed trial to all the charges.

It is learnt that Kamaleshwaran and his family have been living lavishly in the Klang Valley by issuing cheques from a bank account that had been closed.

Yesterday, in the first Sessions Court Yoganandha Moorthy A/L Chitravelu aka Steven Raj was charged with eight counts and in the second court, three counts.

Deputy public prosecutor Geethan Ram Vincent said Yoganandha Moorthy A/L Chitravelu aka Steven Raj and Mercy were married according to customary rites.

He also said on Dec 1, 2006, Yoganandha Moorthy A/L Chitravelu aka Steven Raj was charged at the magistrate's court but the court subsequently granted him a discharge not amounting to acquittal on Jan 20, 2007, after he failed to show up on several occasions.

"He was also under restricted residence in Jeli, Kelantan, for three years from 2005 and had contravened the order three times."

Geethan proposed a bail of RM90,000 in one surety for Yoganandha Moorthy A/L Chitravelu aka Steven Raj and RM60,000 for Mercy.

In pleading for a lower amount, Yoganandha's counsel S. Narasimhan said his client had jumped bail earlier because he was wanted in several police stations in the country.

"Yoganandha Moorthy A/L Chitravelu aka Steven Raj is the sole breadwinner in his family and has two children aged six and two years old." Let's put it this way, if the court/judge continue to listen to Yoganandha Moorthy A/L Chitravelu aka Steven Raj, more and more people will suffer from more cheating cases by this conman family.

Narasimhan agreed with the prosecution that the couple had been living together for eight years.
However, Mercy's lawyer A.G. Kalidas said there was no legal marriage and added that they were not living together at present.

Judge Rosbiahanin Arifin granted Mercy RM50,000 bail in one surety and granted Yoganandha Moorthy A/L Chitravelu aka Steven Raj RM80,000 bail in one surety.

Rosbiahanin set Feb 13 for mention of the cases.

In the second court, judge Rozana Ali Yusoff granted Yoganandha RM30,000 bail in one surety for the three charges.

Another charge for ‘Datuk Kabi’

IPOH - PERAK - MALAYSIA: The infamous “Datuk Kabi” claimed trial in a magistrate’s court here for cheating a man five years ago, adding on to a long list of such charges he already faces.

Datuk Kabi, whose real name is C. Kamaleshwaran, pleaded not guilty to deceiving one G. Balasubramanyam into handing over a total of RM4,500.

The money was believed to have been handed over to him as down payment for a Proton Perdana V6 car worth RM78,000.

He had allegedly committed the offence at 19A, Lebuh Medan 5, Bandar Baru Medan Ipoh, between April 26 and April 29, 2003, all the while knowing that the registration number PEQ 2359 actually belonged to a Perodua Kancil.

Magistrate Mohamed Ruhizat Abdullah set bail at RM4,000 in one surety pending hearing on April 24.

Kamaleshwaran, 29, faces eight other charges at the Balik Pulau, George Town and Butterworth magistrates courts.

His elder brother C. Yoganandha Moorthy, 35, and ex-wife Mercy Sumathi Christie, 39, have also been charged in court for similar offences.

KUALA LUMPUR - MALAYSIA: The elder brother of C. Kamaleshwaran, who goes by the name “Datuk Kabi,” was charged in two courts here with 11 counts of cheating.

Unemployed Yoganandha Moorthy A/L Chitravelu aka Steven Raj, 35, had jumped bail in 2007.



He calmly pleaded not guilty to all the charges while handcuffed to the dock stand yesterday.

His co-accused, Mercy Sumathi Christie, 39, also claimed trial to six similar cheating charges.

Christie is believed to have been married to him traditionally but not living together with him now.

The two allegedly duped a wireman, a plumber and a mover of more than RM25,000 for services rendered by the victims between Sept 2 and Oct 26 last year.

They also faced two charges of cheating Chan Kin Wai, 30, into believing that cheques worth RM20,000 and RM50,000 respectively could be cashed and induced him into handing over the keys to a house in Jalan Langgak Golf for rental at the same place between Oct 19 and Oct 24 last year.

Yoganandha was also slapped with a charge of cheating V. Kodivelu, 30, into believing that cheques worth RM14,400, RM20,980 and RM15,260 were payable after inducing him into giving computer and other equipment.

If convicted, each accused could be jailed up to 10 years, whipped and fined on each count of cheating under Section 420 of the Penal Code.

Earlier, DPP Geethan Ram Vincent pressed for a higher bail for each case, saying that Yoganandha had been charged with cheating at a magistrates court on Dec 1, 2006 but he had jumped bail on Jan 20, 2007.

DPP Geethan said Yoganandha had also violated a three-year Restricted Residence and was charged on Jan 4 in Kelantan.

His lawyer S. Narasimhan pleaded for lower bail, saying that his client had two young children and was the sole breadwinner.

“He jumped bail as he was concerned that he was wanted by several police stations in Malaysia. I believe the accused will use this forum (court) to clear his name,” he said.

Christie’s lawyer A.G. Kalidas asked the court to set a lower bail, saying that his client had co-operated with the police.

The Sessions Courts granted total bail of RM110,000 for Yoganandha and RM50,000 for Christie.

Judge Rozana Ali Yusoff fixed three days from Aug 17 for a joint trial while judge Rosbiahanin Arifin set Feb 13 for mention of the other cases involving Yoganandha alone.

‘Datuk Kabi’ faces eighth charge

BUTTERWORTH - PENANG - MALAYSIA: The man who goes by the name “Datuk Kabi” has claimed trial to yet another cheating case at a magistrate’s court here.

It was his eighth cheating case. The other seven cases were heard at two courts on Penang island earlier this week.

C. Kamaleshwaran, 29, was charged with cheating Wong Hon Chong, 29, by inducing him to surrender his Proton Perdana for sale.

He was alleged to have committed the offence at 4382, Jalan Bagan Luar, here in March 2004.

He pleaded not guilty before magistrate Chiang Kian Hong.

Kamaleshwaran pleaded for leniency and told the court he would not abscond. He assured the court he would be present at his trial.

Assistant Public Prosecutor Siti Aishah Ramlan asked the magistrate to deny him bail as the accused faced several other cheating cases.

Chiang granted him RM20,000 bail with one surety.

He fixed Nov 11 for the case to be mentioned.

Kamaleshwaran, who was represented by S. Narasimhan, did not post the bail.

‘Datuk Kabi’ denies four more cheating charges

GEORGE TOWN - PENANG - MALAYSIA: The man who goes by the name “Datuk Kabi” has claimed trial to four more counts of cheating to add to the three he was already charged with in the past few days.

The new charges against C. Kamaleshwaran, 29, are that he allegedly cheated:

> S. Gobalakrishnan, 35, by inducing him to deposit RM1,750 into his RHB Bank account as supposed payment for a Proton Waja at the Soho Beach Club in Batu Ferringhi here at 9pm in April 2003;

> Fiesal Amdan, 35, of a Honda Civic by inducing him into believing that an AmBank cheque for RM20,000 as purported payment was genuine at the ground floor of Sunnyville in Jalan Batu Uban, Sungai Nibong, on Sept 6, 2004;

> Abdul Razak Hamid, 49, of a Toyota Harrier by inducing him into believing that an AmBank cheque for RM135,000 as purported payment was genuine at a unit in Sunnyville on July 29, 2004; and

> S. Puvaneswaran, 32, of a Proton car by inducing him into believing that an AmBank cheque for RM30,000 as purported payment was genuine at a food outlet in Green Lane at 11.30am on Sept 3, 2004.

He was allowed bail ranging from RM5,000 to RM7,500 for each charge.

Feb 10 has been fixed for mention of the cases.

Kamaleshwaran had in the past few days been charged with three counts of cheating involving three cars worth RM267,000, and was allowed bail totalling RM23,000.
